By accessing or using Facify (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms apply to all users, including administrators, members, and anyone who accesses the Service on behalf of an organization.
Facify is a multi-tenant workflow automation and touchpoint management platform that integrates with Salesforce organizations. The Service allows authorized users to manage contacts, orchestrate outreach workflows, and track communications activity synchronized from connected Salesforce organizations.
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use. Facify reserves the right to suspend or terminate accounts that violate these Terms.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to send unsolicited communications, violate applicable law, infringe third-party rights, or attempt to gain unauthorized access to any part of the Service or its infrastructure.
When you connect a Salesforce organization, you authorize Facify to access, synchronize, and process data from that organization as necessary to deliver the Service. You represent that you have the authority to grant this access on behalf of your organization and that such access complies with your Salesforce license terms.
Our collection and use of personal information is governed by our Privacy Policy, available at facify.io/privacy. By using the Service, you consent to those practices. If your use of the Service involves processing personal data on behalf of others, the Data Processing Addendum at facify.io/dpa also applies.
Facify and its licensors retain all intellectual property rights in the Service, including software, design, trademarks, and content. These Terms do not grant you any ownership rights. You retain ownership of your data and content submitted to the Service.
The Service is provided "as is" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Facify does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by law, Facify and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages. Our aggregate liability will not exceed the greater of $100 or the amounts paid by you to Facify in the twelve months preceding the claim.
You agree to indemnify and hold harmless Facify and its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
Either party may terminate these Terms at any time. Facify may suspend or terminate your access immediately if you breach these Terms or if required by law. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will do so.
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois.
We may update these Terms from time to time. We will notify you of material changes by posting the new Terms and updating the effective date above. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
